Overview

Rhett Owens is an attorney in the firm's Birmingham office.  Before joining HBS, Mr. Owens worked for 8 years as a litigator with Burr & Forman, LLP.  His practice focuses on the representation of clients in a variety of professional liability cases, including medical malpractice and elder care abuse and regulatory non-compliance cases, and he recently published an article on the subject, "A Right to Refuse: The Legalities of a Pregnant Patient's Refusal of Medical Treatment," in the Alabama Lawyer, which has a circulation of almost 18,000 subscribers.  Mr. Owens also has significant experience in representing governmental clients in cases involving alleged constitutional violations, and in representing clients in securities-related litigation, including FINRA arbitration actions.  Mr. Owens has served as second chair in two federal jury trials and three FINRA arbitration actions, and has served as lead counsel on countless cases, appearing before state and federal courts in Alabama on a litany of pretrial issues, including a significant number of cases involving requests for temporary restraining orders and preliminary and permanent injunctive relief, primarily in the context of allegations regarding the theft of trade secrets and the violation of non-competition agreements.
In 2012, Mr. Owens was recognized as a "Rising Star" of the Birmingham Bar by B-Metro Magazine, and in 2013 and 2015 was named an Alabama Super Lawyers Rising Star.  More recently, Mr. Owens has been recognized as a 2016 Mid-South Super Lawyers Rising Star.  
Outside of his practice, Mr. Owens enjoys spending time with his wife, Gunter, and their two children, Helen and Charlie.  He also enjoys playing golf, reading, and working on his house and yard.  He and his family are active in their Church, the Cathedral Church of the Advent, and in its small group and homeless outreach programs.

Aging Services

Mr. Owens regularly represents providers in a variety of aging services matters, including allegations of elder abuse and regulatory violations.

Business Litigation

Mr. Owens’ broad experience encompasses all aspects of company v. company litigation, including trade secret protection and misappropriation, employee raiding, breach of contract, and tortious interference.

Construction

Mr. Owens recently served as primary attorney in construction-related litigation on behalf of a client that claimed almost $400,000 in damages relating to its service as a general contractor on a federally funded, state administered sidewalk construction project.

Fiduciary Litigation

Mr. Owens has extensive experience in all aspects of securities-related litigation and is preparing for implementation of new rules issued by the Department of Labor which change the standard applicable to broker-dealers who provide advice relative to IRA and 401(k) investments from a suitability standard to a fiduciary standard.

General Liability

Mr. Owens has wide-ranging experience in personal injury litigation, co-employee liability cases, and premises liability actions.

Professional Negligence / Medical Malpractice

Mr. Owens regularly represents providers in a variety of medical malpractice actions, including actions before administrative and credentialing tribunals.

Transportation

Mr. Owens has extensive experience in prosecuting and defending trucking accident-related claims.

Wills, Trusts, Estate Planning & Administration

Mr. Owens has experience in preparing estate planning documents, including wills, durable power of attorney, and health care directives, and in litigating estate administration matters.
