James H. Fisher II is a Partner in HBS Atlanta office. He chairs both the HBS Construction Practice Group and Property/SIU Practice Group.
A native of Idaho Falls, Idaho, Mr. Fisher received his Juris Doctor from the Emory University School of Law in 1976.
Mr. Fisher’s statewide practice is devoted to providing solutions related to litigation, regulation, and issues arising out of the frequently interrelated areas of construction, transportation and insurance.
Whether it is a catastrophic injury, complex insurance coverage issue, construction dispute, or transportation incident, Mr. Fisher has tried and mediated many such cases in both state and federal courts for more than 30 years throughout the state of Georgia. He is also a member of the American Bar Association and Defense Research Institute.
Mr. Fisher is AV® Preeminent™ Peer Review Rated by Martindale-Hubbell, and was named to the ALM and Martindale-Hubbell Top Rated Lawyers in Construction Law list in 2013. He frequently speaks on issues related to litigation and insurance law.
Mr. Fisher chairs the HBS Construction Practice Group. He has been involved in the representation of developers, owners, contractors, subcontractors, architects and engineers, construction managers, suppliers, transportation providers and haulers, and insurance carriers in nearly every aspect of the construction industry for more than 30 years. He focuses on providing solutions and problem avoidance strategies for his many clients in this industry.
His construction experience includes litigation; claims involving construction design and defect, delay, change orders and extra work; systems engineering; contract compliance; insurance coverage; regulatory or grading; hydrology and erosion control; heavy equipment and personal injury; and property damage.
Mr. Fisher has served as a Special Assistant Attorney General representing the Georgia Department of Transportation in connection with construction litigation. He has been called upon to represent numerous national insurance carriers to the construction industry in connection with complex claims, disputes and coverage litigation. He is also actively involved in industry and professional organizations, and he is a member of the Construction Law Committee of the USLaw Network of trial attorneys.
Mr. Fisher has vast experience in litigation arising out of trucking, automotive, products and premises liability claims, including wrongful death, throughout the Southeast.
Mr. Fisher's insurance coverage experience includes coverage analysis and litigation arising out of coverage decisions pertaining to life, property and casualty coverage issues, including bad faith, employee dishonesty, apportionment, uninsured motorist, causation, business interruption, and excess coverage under commercial, personal, inland marine and specialty line policies.
As chair of the Property/SIU Practice Group at HBS, Mr. Fisher has concentrated his practice in this area for more than 30 years. He handles arson, fraud and suicide claims for property and casualty, and life insurance carriers nationwide. He has tried and arbitrated numerous cases in this area in both state and federal courts. Mr. Fisher is a frequent speaker around the state and country on these issues.
Mr. Fisher has extensive experience in third party litigation arising out of trucking, automotive, products, and premises liability claims involving catastrophic injury and wrongful death. He chairs the firm’s transportation practice group, which is comprised of attorneys with vast litigation and coverage experience in 3PL, broker, carrier, cargo or liability claims and coverage issues.
Having represented carriers, brokers, operators, and insurers engaged in trucking and the transportation industry, Mr. Fisher has been involved in catastrophic injury cases involving liability issues unique to trucking and Federal Motor Carrier Safety Regulations.
