Overview

David Younker is an attorney in the Atlanta office of Hall Booth Smith.  David specializes in civil litigation matters and possesses extensive trial experience.  David regularly handles various types of civil matters including medical malpractice, retail liability, business litigation, premises liability, environmental, general liability, appellate, and coverage matters.
David handles cases throughout the State of Georgia.Before moving into civil practice, David served as an Assistant District Attorney in the Griffin Judicial Circuit (Fayette, Spalding, Pike, and Upson Counties) where he successfully prosecuted hundreds of felony criminal cases, won many jury trials, and handled multiple appellate matters.  David was privileged to work with victims of crimes against women and children.
David grew up in Marietta, Georgia attended high school in Powder Springs, and graduated with three degrees from the University of Georgia. He received his Juris Doctor from the University of Georgia Law School after receiving both a Bachelor's Degree in Political Science and a Master's Degree in Education focused on Social Sciences. While at Georgia, David was a member of Moot Court and Mock Trial. David married his college sweetheart, Kathryn, in 2010. They welcomed a daughter in 2014 and a son in 2016. 

Practice Areas

Appellate

David has extensive experience handling interlocutory and post-verdict appellate matters.  David has handled over fifteen appeals in Georgia appellate courts and is admitted to both the Georgia Supreme Court and Georgia Court of Appeals.  In successfully handling civil and criminal appeals, David brings both a procedural and substantive approach to handling appellate issues.  David also assists other attorneys prepare for oral arguments before the Court of Appeals and focuses on tailoring successful argument strategies to the specific judicial officers to whom an appeal is assigned.

Correctional Health Care

As a former prosecutor, David possesses insight into the operations of correctional institutions. David's relationships with current and former members of law enforcement as well as third party service providers provide a foundation for understanding the complex and dynamic issues facing our men and women in uniform, county and state facilities, and third parties providing valuable services to the correctional health care arena.

Dental

David is also honored to represent dentists and dental practices.  In understanding that dental practices are different than medical practices, David brings a practical approach to considering dental cases.  David discusses practice management with dentists who seek to improve their communication with their patients and handle the complexities of a modern practice.  Additionally, David works with dentists to understand their record keeping and technological capabilities and how each factor in to potential claims.  David provides beginning-to-end representation of dentists and their practices who face lawsuits.  David works with dentists from the investigation phase all the way through trial.  

Environmental, Mass Torts & Land Use

David has represented clients in complex environmental claims.  In dealing with these complex matters, David provides specific statutory analysis and well as detailed investigation to assist clients in evaluating cases.  David focuses on working with governmental entities to ensure compliance as well as seek positive outcomes that benefit all parties.  In the case of litigation, David works on attempting to provide detailed early evaluations to allow clients to consider all options early in the process to achieve the best resolution possible.

General Liability

David has represented individuals and companies in general liability negligence actions. With his extensive jury trial experience, David brings a practical approach to the table through his understanding of witnesses and jurors. David uses this knowledge to assist clients who seek an early resolution or an aggressive defense at trial.

Insurance Coverage

With his investigative background as a former assistant district attorney, David has experience prosecuting fraud claims and working with state agencies. In applying those skills to civil practice, David conducts initial coverage investigations to assist clients in conjunction with his experience in all aspects of insurance defense. David has a specific focus on potential fraud and identity theft investigations.  He works with clients to identify where individuals may attempt to circumvent the law and find solutions for clients in responding to the actions of said individuals.

Professional Negligence / Medical Malpractice

David is honored to represent medical professionals and medical facilities.  David works with hospitals, doctors, and nurses to navigate the legal process, develop trial strategy, and try cases.  David has experience in high exposure cases and has served with first chair experience medical malpractice matters.  David focuses on providing legal analysis and counsel to assist both the provider and facility consider options and navigate the process.  David has investigative, trial, and appellate experience in this area.  Additionally, David assists medical facilities in evaluating policies and procedures as well as their record keeping programs.  David’s goal is to assist clients both inside and outside the courtroom.

Retail and Hospitality

David has significant experience involving the retail industry.  David regularly represents stores, companies, and retail establishments in a variety of matters.  David assists companies in evaluating their policies and procedures to guard against premises liability actions.  In litigation cases, David walks clients through the process of evaluating a case, identifying appropriate corporate representatives, working to understand relevant statutory considerations, and prepare for trial.  As a company is only as strong as its employees, David specializes in working with company employees to understand the legal process, prepare for depositions/trial, and assist their employers in complex litigation matters.  David regularly works with risk management and loss prevention in augmenting their approaches and improving their practices.
