“Navigating Georgia’s Updated Film Tax Credit Program,” Tax Notes

In a recent article published by Tax Notes, Michael J. Price shares what the mandatory audit implementation in House Bill 129 and House Bill 475 mean for Georgia’s film and television production industry. 

“Fueled by the film tax incentive under Ga. Code Ann. section 48-7-40.26, which has operated since 2008, Georgia is now subject to competing pressures: maintaining a competitive position in a global market while managing the fiscal impact of an uncapped program that represents a substantial tax expenditure for the state,” Price explains. “Lee Thomas of the Georgia Film Office emphasized that ‘Georgia’s film tax credit continues to be reliable and strong’ — a message directed at an industry that makes location decisions years in advance. The Georgia Legislature’s response came through two measures: H.B. 475, which modernizes the production credit to make it available for streaming platforms, and H.B. 129, which revives the expired postproduction credit from January 1, 2026, through December 31, 2031.”
