As millions are vaccinated, health care professionals and hospitals face potential liability issues ranging from adverse reactions to mishandling dosage requirements. Exacerbating the situation is the variance in vaccine delivery method and strategy that exists from state to state in the U.S.
While some legal experts find few liability concerns related to vaccine distribution under the protections of the PREP Act, others maintain that the Act’s provisions are subject to limitations.
“Despite the PREP Act declaration, there is a large volume of COVID-related litigation already at both the federal and state levels, and new suits are being filed every day,” says Hall.
