“An individual does not have to be a patient of a covered entity, for the covered entity’s collection of that individual’s information to be PHI. The information only has to pertain to the individual’s past, present or future physical or mental health or condition, or the provision of health care to an individual,” said Richard.
“If cookies collect information from an individual that is one of the 18 identifiers, and the individual transmits information that relates to their past, present or future physical or mental health or condition, the information collected by the cookies can be subject to HIPAA.”
