Mr. Martin is a partner in the Atlanta office. He is a graduate of the Charter Class of Georgia State University School of Law. With over 30 years of active practice of law, Mr. Martin has been involved in courtroom procedures and trials since his graduation in 1985. Mr. Martin served as the Courtroom Administrator and Senior Law Clerk for ten years to Judge Jack B. Smith, Senior Judge of the State Court of DeKalb County. His ten years hands-on experience in the presentation and preparation of trial practice brings unique and specialized skills to his practice of law. Mr. Martin's emphasis since joining Hall Booth in 1998 has been in the defense of medical negligence matters including birth trauma, long term care, as well as dental matters.
Mr. Martin was appointed as a Commissioner for Georgia to the National Conference of Commissioners of Uniform State Law in 1999. He was successively reappointed by the Governors until 2012. He served as the legislative liaison for the National Conference for Georgia from 1998 until 2010. He has actively been involved in the enactment and passage of major legislation including the Medical Records Release Act, Article 9 of the UCC, Article 7 of the UCC, and has been appointed to several drafting committees for the National Conference of Commissioners on Uniform State Law.
Mr. Martin is a part of the Firm's Dental Practice Group, as well as a member of the Firm's Long Term Care and the Firm's Birth Trauma and Catastrophic Injury Litigation Practice Groups. With extensive, wide-ranging background and experience in all phases of medical liability cases, Mr. Martin has been retained to attend and monitor trials of high-risk cases and to monitor and assess the exposures on these cases. Mr. Martin's over 30 years experience in the courtroom has provided him with a unique and extensive experience in the courtroom in the psychological experience and evaluations of juries and jury trial determinations.
His extensive experience in the courtroom and with the legislature provides Mr. Martin exceptional skills in the evaluation and assessment of all phases of medical liability claims. With years of experience in areas as diverse as birth trauma to long term care, Mr. Martin's skill and experience with medical liability issues and healthcare laws are an unmatched asset, which he brings to the Firm's clients.
Mr. Martin brings extensive experience in dealing with both large and small business transactions. Prior to his work at Hall Booth, Mr. Martin was corporate counsel for a major internet provider. He was involved in all aspects of corporate practice as Corporate Counsel. His experience includes the acquisition and purchase of several smaller entities as well as corporate reorganizations. Mr. Martin also has extensive experience in the formation and operational aspect of his clients including the acquisition of physician practices, private placements, and asset purchase agreements. Mr. Martin brings a seasoned and experienced skillset with regard to all levels of business transactions envisioned in the busy corporate environment.
Mr. Martin's medical and transactional experience comes together in his successful representation of dental practices. Mr. Martin's expertise in providing sound legal advice in the day to day legal matters encountered in a dental practice are well recognized. His synergy in assisting his dental clients includes operating agreement, employment, consent forms for dental procedures, lease agreements, independent contractor arrangements, landlord tenant issues as well as all health care related issues encountered in dental practice including liability issues and claims of professional negligence.
Mr. Martin is an integral part of the HBS health care practice group. He has extensive experience drafting and executing physician contracts, vendor agreements, policies and procedures, and operating agreements. He is well versed in HIPAA laws and regulations as well as EMTALA, anti-kickback laws, and the Stark laws.
Mr. Martin has developed and maintains an extensive and diverse litigation practice. A majority of Mr. Martin's litigation clients involve the defense of physicians and hospitals. Mr. Martin's clients include CNA, AIG, St. Paul, Travelers, Zurich, and the Georgia Hospital Association. He has extensive experience in all aspects of birth trauma litigation including dystocia, CP, and fetal demise.
