Monitoring and Supervising Counsel Services for Excess Insurers

  • Case Oversight: We track progress of the underlying litigation to ensure that defense strategies align with best practices and protect the exposure of excess layers.
  • Defense Counsel Coordination: We maintain regular communication with appointed Defense Counsel; evaluate case handling; engage in litigation tactics and strategies, with particular focus to ensure that aggressive damages evaluations are being performed; and adherence to case budgets and reporting guidelines.
  • Settlement Analysis: We offer candid, data-driven, evaluations of settlement demands and trial risks; while assisting clients make informed decisions about negotiation strategies and financial exposure.
  • Reporting and Communication: Our Team delivers clear, concise, and frequent reports to excess carriers, which will include summarizing key case developments, reserving recommendations, and key strategic considerations.
  • Trial Monitoring: For cases approaching trial, we provide in-depth assessments of trial risk, venue and jury dynamics, and potential outcomes. For those cases in the trial stage, our experienced team will be there in-person in order to provide day-to-day reports, evaluations, recommendations, and immediate communication as it occurs in the courtroom. This service permits the excess insurers to anticipate and respond effectively during the pre-trial and trial stages of the case.
