What Hospital Boards Need to Know About Nuclear Trials

In a recent article published by the Daily Report, Sheila Kazemian and Terrell “Chip” Benton analyzed the issue of Georgia’s nuclear verdicts and offered advice on how hospital boards can navigate the aggressive litigation market. Kazemian and Benton shared a strategic decision framework that defense counsel should consider following in evaluating liability and exposure in cases.

“We have to try the cases that are defensible and defend good medicine. This will show jurors they can trust the healthcare system and discourage plaintiff attorneys from going after or stringing along hospital systems in litigation,” they explained. “The fear of Georgia’s nuclear verdicts is a rational response to an aggressive litigation market, but we cannot let fear dictate the decision as to whether a case should be tried.”
