Part B News: Sandra Cianflone on the End of the COVID-19 PHE
In a Part B News article published on February 13, Atlanta Partner Sandra Cianflone provides commentary on the end of the COVID-19 Public Health Emergency (PHE) and its impact on Emergency Use Authorizations (EUAs) and liability immunity.
Emergency use authorizations are made pursuant to an emergency declaration by HHS,
Cianflone explains. Because this authority was given to HHS in times of emergency under the [FD&C] Act, EUAs will not be coupled with the end of the PHE.
She also says that liability immunity for some pharmacists and health care providers with expired licenses to order and administer COVID vaccines may continue after the PHE ends. The specific end date of PREP Immunity will vary based upon the specifics outlined in the [official HHS] Declarations,
added Cianflone.
