Kirk is an associate in the Brunswick office of HBS and practices in a variety of areas, including Intellectual Property, Professional Negligence and Medical Malpractice, and General Insurance Defense Litigation.
Kirk received his J.D., with honors, from the University of Minnesota Law School. While in law school, he was a member of the Intellectual Property Moot Court and served as President of the Sports Law Association.
A native of Athens, Georgia, Kirk graduated from the University of Georgia with Bachelor's degrees in International Affairs and Political Science. As an undergraduate, Kirk was a member of the University of Georgia Cross County and Track and Field Teams, a sports radio host and beat writer for Georgia basketball and baseball for WUOG 90.5fm, the editorial cartoonist for The Red and Black, and a member of the Phi Kappa Literary Society, where he competed on the intersociety debate team. Kirk also served as the founder and President of Nourish International's University of Georgia Chapter and as Advocacy Coordinator for Safe Campuses Now. After graduating, Kirk was the host of a nightly sports radio show on 790 the Zone in Atlanta, Georgia.
Kirk and his wife, Brittany, live in Jacksonville, Florida with their two rescue dogs, Bella and Avett.
Kirk handles and represents insureds through all phases of liability litigation, including mediations, motion practice, hearings, summary adjudication, trials, and appeals. Kirk primarily represents the interests of insureds in premises liability, auto liability, and professional liability cases.
Kirk has advised filmmakers, artists, musicians, small businesses, non-profits, and governments on a wide-range of intellectual property issues. He has experience in the areas of patents, trademarks, copyright, trade secrets, DMCA compliance, ICANN proceedings, TTAB appeals, and FDA rules regarding Abbreviated New Drug Applications (ANDA).
Kirk has advised delegates to the WIPO Standing Committee on Trademarks regarding the negotiation and development of a new industrial design formalities treaty; provided litigation support and guidance to patent holders facing invalidity proceedings in Brazilian courts; and developed guidance and best practices for IP management and licensing for non-profit organizations, small businesses, pharmaceutical drug development partnerships. He has also managed copyright licensing and clearances for artists and musicians and recently served as production counsel for a film selected for the 2016 Santa Barbara International Film Festival.
Additionally, Kirk assists small businesses and non-profits with all aspects of IP protection and monetization including licensing agreements, prior art searches, infringement monitoring, non-compete and non-disclosure agreements, and trademark and copyright registrations.
Kirk represents hospitals, health systems, skilled nursing facilities, physicians, surgeons, dentists, nurses, and other medical professionals from pre-suit claims and investigation through mediation, motion hearings, summary adjudication, trial, and appeals. Kirk has successfully obtained summary judgment on behalf of skilled nursing facilities in professional liability actions.
