Denise E. Weiner
Biography
Denise Weiner is a Partner in the Atlanta office of Hall Booth Smith. Denise serves as the past president of the Tort and Insurance Practice Section of the State Bar of Georgia and is a frequent speaker at the Southern Loss Association, Atlanta Claims Association, Southeastern Arson Seminars, Georgia Fire Investigators Association and for many national insurance carriers. Denise is the past president of the Georgia Chapter of the National Society of Professional Insurance Investigators. She has been recognized as a “Rising Star” by Super Lawyers magazine four times.
Service Specific Experience
Denise provides advice and counsel to general contractors, subcontractors, owners, developers and design professionals in cases involving construction defects, construction accidents and construction contracts. Her practice is focused on the litigation of construction cases, including mediation, arbitration and trials in both state and federal courts throughout Georgia. Recently recognized as a Super Lawyer Rising Star, Denise advises national insurance carriers and construction entities on matters of risk management, insurance coverage analysis, drafting and review of construction related agreements and documents, construction defects, performance and payment disputes, mechanics liens, OSHA compliance, insurance and regulatory or workplace and other catastrophic injury claims or damage to property. She has served as a Special Assistant Attorney General in litigation involving highway construction for the Georgia Department of Transportation.
Denise‘s litigation experience has included third party general liability cases throughout the Southeast. These have included trucking and automotive incidents as well as products and premise liability claims, including wrongful death and others. Her broad experience allows her to represent a varied range of client issues related to general liability claims.
Denise has extensive experience in providing insurance coverage opinions regarding life, property, and casualty coverage issues including CGL policies, bad faith, uninsured motorists, causation, and excess coverage under commercial and personal policies.
Denise has been actively involved in the Property/SIU practice group since she began practicing law. She has successfully handled first party claims involving arson and fraud from claims denial up to and including trial.
Whether broker, carrier, cargo or liability claims or coverage issues, Denise has broad litigation and coverage experience. Having represented carriers, brokers, operators and insurers engaged in trucking and the transportation industry, Denise has been involved in catastrophic injury cases involving liability issues unique to trucking and Federal Motor Carrier Safety Regulations.
