Biography

Mark Maholick is a partner in the firm’s Columbus office and concentrates his practice in the areas of private and commercial vehicle transportation, insurance coverage, general liability, governmental liability, workers’ compensation, retail liability, long-term care and the senior housing industry, and medical malpractice.

Mark has tried numerous cases involving automobile liability (private and commercial), general liability, and premises liability. Mark is regularly involved in litigating all aspect of insurance coverage matters, health care regulatory issues, medical malpractice cases, and special investigative unit insurance issues.

He has handled cases for both the uninsured and for 20-30 different insurance companies. He is regarded by his peers and the members of his firm as an expert in issues involving UM (uninsured / underinsured) coverage under Georgia’s complex statutory and caselaw based framework. Mark fields questions from both insurers, individuals, and other attorneys throughout the state on a weekly basis regarding automobile insurance coverage questions and issues.

Mark attended Walter F. George School of Law at Mercer University and graduated cum laude. He was awarded with the Drew W. Paulk Honorary Scholarship and the Guerry R. Moore Insurance Law Award, and he is a member of both the American Bar Association and the Columbus Chamber of Commerce. He and his wife, Mandy, are lifetime residents of Columbus.

Aging Services

Mark has been involved in representing numerous nursing homes and rehabilitation centers in the greater Columbus area. He is also experienced in representing other types of long-term care and housing industry agencies including those funded through Medicare and Medicaid such as SOURCE (Service Options Using Resources in a Community Environment).

Dental

Mark’s medical and transactional experience comes together in his successful representation of dental practices. Mark’s expertise in providing sound legal advice in the day-to-day legal matters encountered in a dental practice are well recognized. This includes matters involving patient consent forms, lease agreements, independent contractor arrangements, landlord tenant issues, as well as all health care related issues encountered in dental practice including liability issues and claims of professional negligence.

Insurance Coverage

Mark has represented numerous insurance companies and their insureds in both first party and third party suits. He has vast experience in all aspects of insurance defense from the filing of the case through trial.

Medical Malpractice

Mark has served as counsel defending hospitals and physicians in medical malpractice actions during his entire legal career. He has vast experience in defending all types of medical claims from the filing of the lawsuit through trial.

Property / SIU

In conjunction with the fast growing area of retail premises liability in Mark’s practice is the area of premises liability concerning privately owned non-retail property. He has represented numerous landowners throughout Georgia in cases involving static property defects and allegations of active negligence on the part of real property owners.

Additionally, Mark is involved in both first- and third-party insurance defense work with various special investigative units dealing mainly with areas of potential insurance fraud. He has successfully handled both first- and third-party claims involving arson and fraud from claims denial up to and including trial.

Premises Liability

Mark represents and has represented a variety of retail establishments including but not limited to restaurants, gas stations, convenience stores, and grocery stores. His representation of these types of establishments has involved all sorts of causes of action that range from a slip and fall to complex allegations of fraud and deceptive trade practices. This area of his practice is the fastest growing area, especially from the premises liability perspective of retail liability.

Transportation

Mark has extensive experience in third party litigation arising out of trucking, automotive, boating, and other types of vehicular liability claims involving catastrophic injury litigation and coverage experience. This area of law is Mark’s primary area of practice and expertise.
