Georgia Judge Orders Litigation Funding Company to Produce Documents Related To Its Funding of Plaintiff’s Medical Expenses

On Friday, August 7, 2020, Judge Toby Prodgers of the State Court of Cobb County Georgia ordered Cherokee Funding to produce all of its contracts, agreements and any other documents relating to the litigation funding it provided to Plaintiff Patricia Cardona in her personal injury lawsuit. Over the objections filed by counsel for Cherokee Funding, Judge Prodgers found that these documents are discoverable as they “may be admissible to show bias on the part of the providers and attack the credibility of the provider’s opinions.” He found that they may also be admissible on the issue of the reasonable value of the medical services provided.
