Hall Booth Smith, P.C. is excited to welcome Joel I. Fishbein as of counsel in the Aging Services Practice. Fishbein brings more than three decades of litigation and risk management experience to the firm, representing long-term care providers, hospitals, physicians and businesses in complex disputes.

About Joel Fishbein

Joel focuses his practice on acute and post-acute care, aging services, health care, medical malpractice, appellate law, arbitration & mediation, employment and business litigation. He draws on his extensive background, most recently as in-house director of litigation and risk for a subacute and long-term care provider, to provide strategic counsel in high-stakes matters and guide clients through arbitration, mediation, and trial. He has significant appellate experience, having successfully argued cases in the appellate courts of Pennsylvania and New Jersey setting important healthcare arbitration law precedent.

“His extensive litigation experience and his operational perspective supervising litigation and risk management, both from an in-house and outside law firm capacity, make him an exceptional addition for our aging services and other healthcare provider clients,” shared Drew Graham, partner and chair of the firm’s Aging Services Practice. “His ability to defend complex cases while also helping clients reduce claim frequency by applying lessons learned from litigation will be incredibly valuable to our long-term care provider clients and acute care facilities.”

Before joining HBS, Joel served as Senior Vice President and Director of Litigation and Risk at Complete Care Management, where he developed patient safety strategies designed to reduce claim frequency and he supervised outside counsel collaboratively developing creative legal defense strategies that reduced overall risk exposure across the organization. Earlier in his career, he practiced as partner at several law firms, where he represented clients in Pennsylvania and New Jersey in medical malpractice defense and long-term care litigation.

Joel has tried and arbitrated dozens of cases to successful outcomes in trial and arbitration, including achieving a multi-million-dollar arbitration award on behalf of a business owner. He also secured appellate decisions enforcing arbitration agreements in nursing homes, assisted living and doctor patient contracts.

He received a certification in mediation by Harvard Law School and earned his J.D. from Temple University’s James E. Beasley School of Law, where he served as note and comment editor for the Temple Law Review. Joel also holds a B.S. in Accounting from Pennsylvania State University. He is licensed to practice law in New Jersey and Pennsylvania.
