Legal considerations surrounding reproductive health care are more complex than ever before and continue to change almost daily. Hall Booth Smith has a dedicated team of highly experienced attorneys who counsel health care providers, insurers, employers, patients, and others who provide, seek, or support reproductive health care services.

Experience

We work with clients to analyze and help them comply with interstate matters such as providing care in states other than the state of residence for the patient, provider, or employer. We also counsel clients on emergency medicine, obstetrics and gynecology (OB-GYN) matters, in vitro fertilization (IVF), family medicine, and issues related to seeking or providing reproductive health care services and medication access across state lines.

Our team advises employers on how to handle reproductive matters and how to cover the cost of travel for health care services when needed as part of their health care insurance and benefits packages for employees. We also counsel clients on related issues such as the Family and Medical Leave Act (FMLA), Title VII, the Americans with Disabilities Act (ADA), and state disability claims.

We counsel employers, HR professionals, and benefits professionals on the legal and financial implications of offering monetary support, time off, travel expenses, reimbursements, and other benefits to employees who seek reproductive and other health care services in other states.

HBS is also equipped to advise insurers, health care providers, employers, and other businesses on data privacy issues and compliance with the Health Insurance Portability and Accountability Act (HIPAA) related to reproductive health care, family planning, fertility matters, and personal health information.

We inform our clients about current state reporting requirements, changes at the state and national level that may impact their ability to provide certain reproductive services or care to patients, and implications of interstate health care matters. We are prepared to analyze and advise clients on the civil and criminal implications of state laws and regulations pertaining to services such as abortion, emergency contraceptives, and other medical services.

We also help entities implement internal training programs to ensure that best practices, policies, and procedures are in place and being followed.
