HR.com: Misty Wilson Borkowski on the New Farmworker Protection Rule
Overview
In a recent article published in HR.com’s Payroll, HRIS, Time & Attendance Excellence magazine, Little Rock Partner Misty Wilson Borkowski discussed the implementation of the new Farmworker Protection Rule by the U.S. Department of Labor (DOL), which aims to protect farmworkers through the H-2A program.
“To comply with the new Farmworker Protection Rule, employers must promptly notify H-2A workers and the State Workforce Agency of work delays and provide subsistence and compensation if 10 business days’ notice is not given,” Borkowski said. “Furthermore, employers must apply fair and transparent termination processes, including informing workers of policies in a language they understand, conducting objective investigations, and using progressive discipline before termination unless egregious misconduct is involved. Additionally, employers need to ensure housing standards are met, document compliance efforts, and train staff on the new regulations.”
