In a recent article published by Law Week Colorado, Zubin Chadha discusses the new statutes and court rulings reshape housing development, specifically the Colorado Supreme Court decision in Mid-Century Insurance Co. v. HIVE Construction Inc. and the Colorado American Dream Act, establishing the Multifamily Construction Incentive Program.
Mid-Century Insurance Co. v. HIVE Construction Inc. reinforced limits on negligence claims in construction defect cases. “The court took a more restrictive view of tort claims tied to contractual duties,” Chadha explains. “The ruling clarified that willful and wanton conduct is not exempt from the economic loss rule when the duty allegedly breached arises from a contract.”
“The MCIP promises a more predictable litigation environment for multifamily builders, while still offering heightened consumer protections,” Chadha analyses. “Amendments to the Colorado Common Interest Ownership Act raise the threshold for homeowner associations to pursue construction defect litigation from a simple majority to 65% of unit owners.”
