In a Daily Business Review article, Miami Partner Tullio E. Iacono discusses the voluntary binding medical malpractice arbitration process, which allows damages to be capped when one party voluntarily submits to the process before a lawsuit is filed, whether or not the other side agrees to arbitration: “Once damages are capped, there is less speculation and a great deal more certainty about case value. In many instances, this certainty leads to earlier resolution of medical malpractice cases.”
